Hich they may consecrate and enforce by their manners and customs. There are others of an indifferent nature, respecting which, it rests at the option of nations to make in their treaties whatever agreements they please, or to introduce whatever custom or practice they think proper. But every treaty, every custom, which contravenes the injunctions or prohibitions of the Necessary law of nations, unlawful. It will appear, however, in the sequel, that it is is only by the Internal law, by the law of Conscience, such conventions or are always treaties which condemned as unlawful, and that, for reasons shall be given in their proper place, they are nevertheless often valid by the external law.
But we must not conclude from thence, that the nation wanted a genius for trade.
Nay, the motives to it will lose much of their force, when a government is strong in reputation, and men are kept in good humor by feeling the rod of a party on no occasion, tho they feel the weight of the sceptre on some. Such opportunities, however, may happen; and there may be reason, as well as pretences, sometimes for opposition even in such a reign: at least we will suppose so, that we may include in this argument every contingent case. Grievances then are complained of, mistakes and abuses in government are pointed out, and ministers are prosecuted by their enemies.
