So for the time being I was out of the bands, and just trying to find out what was next for me, if the music thing had played out. I had befriended a guy named Danny in my one semester of Junior College and stayed friendly with him throughout these passing years. It was a working relationship — he dealt the best pot in southern California and always had it. I worked several jobs and then got into a line I did well at: purchasing agent in the aerospace industry. I dealt with inventory and contracts and bids; and I actually liked it.

The Deputy Prosecutor highlighted one harm that the victim was experiencing: fear. The prosecutor suggested that it is this fear that stopped the victim from testifying against the offender. After having identified the harms, one must ask what the victim needs in order to feel that the harm has been addressed and put right. This victim’s needs might have focused on feeling safe again. Her missed appointments with the defense attorney could be seen as sending a message about this fear and the attention that it required.

The harms done, and the needs and obligations that result are central to each of these questions. These issues are pointed out by Jayne Crisp, council to the California’s Victim Forum. In her handbook,14 she emphasizes the importance of acknowledging the victim without ignoring the perpetrator — otherwise, hope of restoration is lost. The starting point for any restorative justice process is identifying the harms resulting from the crime — in this case, a sexual assault. The Deputy Prosecutor highlighted one harm that the victim was experiencing: fear.
