I. Hayakawa introduced such an amendment. It was defeated. S. Congress. S. English, a group founded for that purpose by Hayakawa and Dr. John Tanton, a physician. A review of the record of the hearing on this proposal before the Senate Committee on the Judiciary reveals the familiar nativist concern that language minority groups were not assimilating and therefore posed a threat to the United States. The focus of the presentations in favor of the amendment were clearly concerned with the rising use of the Spanish language, and clearly unconcerned with the Founding Fathers' notion that the cause of national loyalty is served, rather than disserved, by leaving language choices to individuals and not public bodies.

Raymond was only ten years old and had not passed the eighth grade. The teacher, a Mr. Meyer, was charged, tried, and convicted under the Nebraska statute for unlawfully teaching in the German language. The readings he used in this process were a collection of biblical stories. Meyer appealed his conviction to the Supreme Court of the state of Nebraska. He did not dispute that he had committed the acts as charged, but argued that the statute forbidding the teaching of German violated his rights to due process of law under the Fourteenth Amendment to the United States Constitution.
