They can only be removed as a group by the European Parliament. One Commissioner is appointed to head the Commission as its President. The Treaty of Amsterdam Community Institutions 19 strengthened the position of the European Parliament by requiring its approval to the appointment of the President of the Commission. Each Commissioner is allocated a portfolio or area of responsibility from the 20 Directorates General covering all Community policy. The functions of the European Commission are found in Art 211, and indicate the key role envisaged for it by the Treaty.

An aspect of democratic participation which has always been considered important in any parliament is the involvement of elected representatives in the setting of expenditure and income levels, that is, a budget. Although it is the President of the European Parliament alone who has the power to adopt the budget, the procedure for the Community budget is rather complex and has been varied on several occasions. The effect of these changes has been to transfer certain powers from the Council to the Parliament.

Advocates General are given a specific role under Art 222, which states that ‘it should be the duty of the Advocate General, acting with complete impartiality and independence, to make, in open court, reasoned submissions on cases brought before the ECJ, in order to assist the Court in the performance of its tasks. Unlike in senior English courts, where a full judgment is given, including dissenting views, only one judgment is given by the ECJ.
